Below are the terms and conditions of contracting Indie Shopography for your web and graphic solutions that you must agree upon in order for work to continue on your project. There will be a place at checkout confirming that you have read, understand and agree to these terms and conditions. If you do not understand and agree, do not complete checkout, and please contact me.
Indie Shopography does not guarantee specific business outcomes as a result of the business mentoring, strategy, Toolkits, or design and development provided as part of the program offered. Client acknowledges that certain business or brand success stories shared by Indie Shopography during the course of the program are used for illustrative purposes only and should not be construed by any party as a guaranteed outcome as a result of the services and terms of the program and/or the expertise of Indie Shopography. All materials are based on opinion and there is no guarantee on their effectiveness.
Due to the nature of my work, I do not extend returns or exchanges, whether it has already been completed, or has yet to be completed. When you purchase a design, maintenance package, or Toolkits, you will receive what items or time that you purchased. If you do not want a project to be completed, you forfeit your payment.
Timelines given for any project - maintenance or new - not under contract are estimates and can change due to an incalculable number of factors. I will do my work as quickly as possible. In the event that a timeline is stalled due to a client not meeting their deadline for getting content or processing edits for over 30 days, a project will be terminated and no refund will be issued. Additional design time will need to be purchased to complete the project after this time.
Maintenance refers to any request requiring me to work on any aspect of your website, branding or print products that have already been designed/implemented. The design/implementation of new elements will require the fees and scheduling policy of new design.
Maintenance requests requiring more than 2 hours (5-10 tasks, depending) will require booking on my project calendar. This can put your maintenance out up to a month or more, so if you have a large amount of maintenance, book early.
Small amounts of maintenance (requests requiring 5 minutes to 2 hours) will be done by request on Mondays. If my maintenance availability is booked on any given Monday, your maintenance will be booked on the next available Monday. Monday slots, as with a project slots, are first-come/first-serve.
In the event that your maintenance is more pressing and you wish for your maintenance to be "rushed" for the closest Monday to your request, a $50* rush fee will need to be paid at the time of booking for small maintenance, and $100* for large maintenance (limit of 4 hours).
If your maintenance is required IMMEDIATELY, a $100* rush fee will need to be paid at the time of booking for maintenance that takes under 2 hours, and $300* if it will require more than 2 hours.

*Maintenance rush fees are in addition to regular maintenance hours that are pre-purchased. Maintenance rush fees may change at any time and without notification.
Maintenance plans expire one year from the date of purchase.
Hosting is sold through Indie Shopography for Adobe Business Catalyst. Basic hosting price includes server space, CMS, and access to the Business Catalyst support system.
Invoices are sent approximately 2 weeks before each automatic debit. Automatic debit will be made through the card on file.
If you wish to cancel your hosting with Indie Shopography and Adobe Business Catalyst, please contact me at least two weeks prior to your invoice date. You will lose all data on your site when your website is cancelled. Backing up any data is the website owner's responsibility.
No refunds are given for hosting fees.
Indie Shopography is not responsible for any problems associated directly with the Adobe Business Catalyst platform.
Additional support is available and is added to your monthly or yearly hosting fee. This additional support is with Indie Shopography and includes email support only.
Email support comes with an 8-hour promise when support requests are submitted through the client area. Indie Shopography will respond to your submission within 8 business hours (10am-5pm CST Monday-Friday, holidays and vacation days excluded) or you can claim that month's worth of hosting as a refund.
Email support includes email direction for edits and questions. All support requests that require me to take action to fix a problem or conduct an edit is not included as email support and will be invoice at the current hourly rate to the next half-hour.
By enrolling in Toolkits you are authorizing Indie Shopography to automatically debit the credit or debit card that you used for your initial purchase. Invoices are sent approximately 2 weeks before each automatic debit. Automatic debit will be made through the card on file.
If you wish to cancel your toolkit subscription with Indie Shopography, you must do so at least 3 business days prior to the due date of your next invoice. To cancel your subscription please contact David at email@example.com.
The site and its original content, features and functionality are owned by Indie Shopography and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
These terms and conditions shall be construed in accordance with the laws of the State of Tennessee.
By checking that you have "read, understand and comply" to the terms and conditions of Indie Shopography products and services upon checkout, you agree to abide by these conditions, without retract.
